Please read these Terms of Use ("Terms") carefully before using WinterMap ("Service"). These Terms form a binding legal agreement between you ("User") and Lev Kats ("Operator").
MOUNTAIN SPORTS ARE INHERENTLY DANGEROUS. Skiing, snowboarding, and mountaineering involve risks of serious injury or death.
NO WARRANTY OF ACCURACY: WinterMap is a user-generated visualization tool. The terrain, snow conditions, and routes shown may be inaccurate or outdated. GPS errors in mountains can be significant.
USER RESPONSIBILITY: You use this map ENTIRELY AT YOUR OWN RISK. Never rely solely on WinterMap for navigation. Always check official avalanche bulletins and respect local signage.
The Service is currently in a Beta phase and is provided for testing purposes. The Operator reserves the right to modify the Service, but commits to preserving access to user content as defined in Section 3.
By uploading photos or data ("Content"), you declare that you own all rights to such Content.
You grant the Operator a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, distribute, and display such Content in connection with the Service.
You agree that the Operator may monetize the Service (e.g., through subscriptions for premium features, offline maps, or weather layers) without compensation to you, subject to the "Free Access" guarantee below.
The Operator guarantees that basic access to view the database of uploaded photos (as overlaid on the map) shall remain free of charge for all users for the lifetime of the Service.
While the Operator may introduce paid features in the future (such as advanced analytics, offline caching, or specialized data layers), the core ability to view community-contributed photos will not be placed behind a paywall.

These Terms are governed by the laws of Austria. The competent court is Vienna. If any provision is found unenforceable, the remaining provisions will remain in full effect.
